Digitalpro provide their services to you subject to the following conditions. If you visit or shop within this website, you must accept these conditions. Please read them carefully.

ELECTRONIC COMMUNICATIONS

When you visit Digitalpro or send e-mails to us, you are communicating with us electronically. You consent to receive communications from us electronically. We will communicate with you by e-mail or telephone as you wish. You agree that all agreements, notices, disclosures and other communications that we provide to you electronically satisfy any legal requirement that such communications be in writing.

COPYRIGHT

All content included on this site, such as text, graphics, logos, button icons, images, audio clips, digital downloads, data compilations, and software, is the property of Digitalpro or its content suppliers and protected by international copyright laws. The compilation of all content on this site is the exclusive property of Digitalpro, with copyright authorship for this collection by Digitalpro, and protected by international copyright laws.

TRADE MARKS

Digitalpro's trademarks and trade dress may not be used in connection with any product or service that is not Digitalpro's, in any manner that is likely to cause confusion among  customers, or in any manner that disparages or discredits Digitalpro.   All other trademarks not owned by Digitalpro or its subsidiaries that appear on this site are the property of their respective owners, who may or may not be affiliated with, connected to, or sponsored by Digitalpro or its subsidiaries. 

LICENSE AND SITE ACCESS

Digitalpro grants you a limited license to access and make personal use of this site and not to download (other than page caching) or modify it, or any portion of it, except with express written consent of Digitalpro. This license does not include any resale or commercial use of this site or its contents: any collection and use of any product listings, descriptions, or prices: any derivative use of this site or its contents: any downloading or copying of account information for the benefit of another merchant: or any use of data mining, robots, or similar data gathering and extraction tools. This site or any portion of this site may not be reproduced, duplicated, copied, sold, resold, visited, or otherwise exploited for any commercial purpose without express written consent of Digitalpro. You may not frame or utilise framing techniques to enclose any trademark, logo, or other proprietary information (including images, text, page layout, or form) of Digitalpro and our associates without express written consent. You may not use any meta tags or any other "hidden text" utilising Digitalpro's name or trademarks without the express written consent of Digitalpro. YOUR MEMBERSHIP ACCOUNT

If you use this site, you are responsible for maintaining the confidentiality of your account and password and for restricting access to your computer, and you agree to accept responsibility for all activities that occur under your account or password. If you are under 18, you may use our website only with involvement of a parent or guardian. Digitalpro and its associates reserve the right to refuse service, terminate accounts, remove or edit content, or cancel orders in their sole discretion.

PRIVACY POLICIES

Like most places on the Internet, simply by visiting our website you automatically tell us certain information. This includes basic information such as your IP address, when you visited, the website from where you came prior to visiting us, the website where you go when you leave our website, your computer's operating system, and the type of web browser that you are using. Our website automatically records this basic information about you.

Like many other websites, we may use cookies. In plain English, this means information that our website's server transfers to your computer. This information can be used to track your session on our website, to serve ads from Google and other third party vendors, and show our ads on this website and the Internet, based on your prior visits to our website and elsewhere on the Internet.

All transactions between you and our website will involve payment by credit card and/or third party online payment services. In such transactions, we will collect information related to the transaction as part of the course of doing business with you, including your billing address, telephone number, and other information related to the transaction.

We use your information to operate our website's business activities. For example, we may use this data to contact you about changes to our website, new services, or special offers, resolve disputes, troubleshoot issues, and enforce our website's terms and conditions.

As a general rule, we will not give your data to third parties without your permission. However, there are some important exceptions to this rule that are described in the following paragraphs.

We may, in our sole discretion, provide information about you to law enforcement or other government officials for purposes of fraud investigations, alleged intellectual property infringement, or any other suspected illegal activity or matters that may expose us to legal liability.

We work diligently to protect the security of your personal information, including  credit card information.  We protect your credit card information during transmission by using the Secure Sockets  Layer (SSL) protocol, which encrypts your information when transmitted over the  Internet.  Our third party payment gateway (DPS Payment Express) does not store your credit card data in any way.  If conducting business with you via telephone or email we will need to write down your credit card details but once your payment has been processed, your details are shredding and disposed of.  Each team member at Digitalpro has been carefully instructed in the use of credit card information and our disposal policies. 

REVIEWS, COMMENTS, EMAILS, AND OTHER CONTENT

Visitors may post reviews, comments, and other content: and submit suggestions, ideas, comments, questions, or other information, so long as the content is not illegal, obscene, threatening, defamatory, invasive of privacy, infringing of intellectual property rights, or otherwise injurious to third parties or objectionable and does not consist of or contain software viruses, political campaigning, commercial solicitation, chain letters, mass mailings, or any form of "spam." You may not use a false e-mail address, impersonate any person or entity, or otherwise mislead as to the origin of a card or other content. Digitalpro reserves the right (but not the obligation) to remove or edit such content, but does not regularly review posted content. If you do post content or submit material, and unless we indicate otherwise, you grant Digitalpro and its associates a nonexclusive, royalty-free, perpetual, irrevocable, and fully sublicensable right to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display such content throughout the world in any media. You grant Digitalpro and its associates and sublicensees the right to use the name that you submit in connection with such content, if they choose. You represent and warrant that you own or otherwise control all of the rights to the content that you post: that the content is accurate: that use of the content you supply does not violate this policy and will not cause injury to any person or entity: and that you will indemnify Digitalpro or its associates for all claims resulting from content you supply. Digitalpro has the right but not the obligation to monitor and edit or remove any activity or content. Digitalpro takes no responsibility and assumes no liability for any content posted by you or any third party.

PRODUCT DESCRIPTIONS

Digitalpro and its associates attempt to be as accurate as possible. However, Digitalpro does not guarantee that product descriptions or other content of this site is accurate, complete, reliable, current, or error-free. If a product offered by Digitalpro itself is not as described, your sole remedy is to return it in unused condition and we will process your refund as soon as possible.


DISCLAIMER OF WARRANTIES AND LIMITS OF LIABILITIES

This site is provided by Digitalpro on an "as is" and "as available" basis. Digitalpro makes no representations or warranties of any kind, express or implied, as to the operation of this site or the information, content, materials, or products included on this site. You expressly agree that your use of this site is at your sole risk. To the full extent permissible by applicable law, Digitalpro disclaims all warranties, express or implied, including, but not limited to, implied warranties of merchantability and fitness for a particular purpose. Digitalpro does not warrant that this site, its servers, or e-mail sent from Digitalpro are free of viruses or other harmful components. Digitalpro will not be liable for any damages of any kind arising from the use of this site, including, but not limited to direct, indirect, incidental, punitive, and consequential damages.

APPLICABLE LAW

By visiting Digitalpro, you agree that the laws of New Zealand, without regard to principles of conflict of laws, will govern these Conditions of Use and any dispute of any sort that might arise between you and Digitalpro or its associates.

DISPUTES

Digitalpro wishes to settle any problems peacefully and quickly to the benefit of both parties.  Any dispute relating in any way to your visit to Digitalpro or to products you purchase through Digitalpro shall be submitted to confidential arbitration in New Zealand, except that, to the extent you have in any manner violated or threatened to violate Digitalpro's intellectual property rights.  Digitalpro may seek injunctive or other appropriate relief in a court of New Zealand and you consent to exclusive jurisdiction and venue in such courts. The arbitrators' award shall be binding and may be entered as a judgment in any court of competent jurisdiction. To the fullest extent permitted by applicable law, no arbitration under this Agreement shall be joined to an arbitration involving any other party subject to this Agreement, whether through class arbitration proceedings or otherwise.

RETURNS AND REFUNDS

The colour and density settings and the type of your computer monitor that you use to view your image, have an influence on the perception of how your image should look. You should be aware that images viewed in the majority of web browsers are not colour accurate, and that prints may look slightly different. There is also a variation between different paper types. If precise colours are important for you, you should contact us for more information before placing your order. As we cannot guarantee the accuracy of your monitor, we will not accept colour reproduction as a valid reason for return.

Due to the bespoke status of these artworks, items that are delivered as described and in good condition may not be returned but damaged items will be exchanged free of charge. We reserve the right to charge for re-posting returned orders, which have been especially produced to meet your personal requirements.

Clients that are unhappy with the quality of their work should submit all prints to DigitalPro by post for evaluation.  For prints to be considered for reprinting, clients must contact DigitalPro by telephone or email within 24 hours of receiving prints so that we can hold the files from deletion.  Prints sent back to DigitalPro must be received within 7 days of initial contact.

We reserve the right to contact you via telephone or email should we have any questions about your image prior to printing.

FILE TYPES AND COLOUR SETUP

All files MUST be JPEG, RGB and 8bit colour for printing.  All our printers are setup to accept images with an sRGB profile. Make sure that your files are not CMYK, Grayscale or in 16bit colour as we will have to convert each of them and this may void any price discounts and you may be charged for conversion.  You will be notified by email and we will hold your job until confirmation of your continuation is made.

ASPECT RATIO & CROPPING

Please take care to select the correct print size for your image and utilise our cropping tool if needed.  We cannot be responsible for size and resolution errors in the original file. If unwanted cropping occurs because of files that do not fit the aspect ratio size of the print being ordered, we will not reprint your image. Digitalpro will print all files uploaded to the specifications ordered.

IMAGE RESOLUTION

Your file should be 300dpi for any given output size.  If you want a photo quality 4x6" print, your image should be 4x6" and 300dpi. For print sizes 11x14" and larger, 300dpi is satisfactory, but the highest resolution you can obtain is always best while maintaining a workable/uploadable file size. This will bring you the clearest results. If your final prints look a little pixelated, it is because of a lack of resolution and not because of the way it was printed.  A warning is displayed if images are uploaded less than 150dpi.

FOR FASTER TRANSFER

Take care to keep file size at a minimum consistent with your goal, for faster transfers. Do not make the file smaller than minimum requirements for the print size you are ordering.  Files larger than what is needed will only increase the time it takes for you to upload your image.

DAMAGE

It is the customer's responsibility to check for any damage that may have occurred during transit. You have 24 hours from the time of delivery to report any damage to us. It is essential that you contact us within the 24 hours, so that we can claim compensation from the courier company on your behalf, and reprint the prints for you.

TURNAROUND TIME AND DELIVERY

Although we make every possible effort to turn jobs around in the estimated time offered, your job may require more time due to unforeseeable uncontrollable circumstances or finishing services added onto the job. We will not credit customers if a job runs past the estimated turnaround time.

* Please note, delivery times may vary due to CourierPost delivery delays. Although the above times are consistent with our experience, some delays can occur due to events out side our control. We suggest, if you need your prints by a certain date/time, get in contact with us at time of ordering, letting us know the urgency of your prints.  We will try our best to get them to you earlier.

^ Some areas do not have Saturday delivery. In these cases your photos should arrive the next working

 

CLIENT IMAGES

Digitalpro does not share, sell or distribute the images uploaded by clients.  These images are deleted from our online servers within 2 days of upload and from our local hard drives within 7 days of upload.  Files are kept only as a precaution should a problem arise with your order.  We respect your right to privacy and all images are treated with sensitivity.

COPYRIGHT INFRINGEMENT

The customer warrants that the subject matter to be reprinted is not copyrighted by a third party. Customers also recognise that because subject matter does not have to bear a copyright notice in order to be protected by copyright law, absence of such notice does not necessarily assure a right to reproduce. Customers further warrant that no copyright notice has been removed from any material used in preparing the subject matter for reproduction. To support these warranties, customers agree to indemnify and hold Digitalpro harmless for all liability, damages and attorney's fees that may be incurred if any legal action connected with copyright infringement involving the work produced or provided.

Customers also warrant that the work does not contain anything that is libelous or scandalous, or anything that threatens anyone's right to privacy or their personal or economic rights. Customers will, at their sole expense, promptly and thoroughly defend Digitalpro in all legal actions on these grounds as long as Digitalpro notifies customers of legal action and gives the customer reasonable time to undertake and conduct defense. Digitalpro reserves the right to use its discretion in refusing to print anything that it deems illegal, libelous, scandalous, improper or infringing upon copyright law.
